Tokyo, August 5, 1909.

I was informed to-day by Mr. Ishii, Vice-Minister for Foreign Affairs, that, in view of the failure of China to comply to the request of the Japanese Government for permission to take in hand the reconstruction of this railway, the latter Government had determined to wait no longer and to act in accordance with their treaty rights. The "well-known policy of obstruction and procrastination on the part of China had exhausted the patience of Japan. The South Manchurian Railway were therefore to begin the work immediately, as, were it put off till November, the climate at that season would render it impossible to begin operations.

Instructions have been sent to the Japanese Ambassador in London to inform you of the action contemplated by Japan.
